Agreement to These Terms
Welcome to KinCheck. By downloading, installing, or using the KinCheck mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the App.
If you do not agree to these Terms, do not use KinCheck. These Terms apply to all users including seniors, family members, and circle administrators.
Who Can Use KinCheck
To use KinCheck you must:
- Be at least 18 years of age
- Have a valid email address to register an account
- Use the App only for its intended purpose — monitoring and staying connected with elderly family members
- Have access to a compatible Android device
By registering, you confirm that all information you provide is accurate and that you will keep your account credentials secure.
Family Circles & User Roles
KinCheck operates on a family circle model:
- Senior (Circle Owner): Creates the circle, shares an invite code, configures check-in windows and alert times, and controls location sharing.
- Family Member: Joins via invite code to monitor the senior's check-ins, location, SOS alerts, and medication logs.
- Circle Admin: The senior is the circle admin and can remove or suspend family members at any time.
Each circle may have up to 8 members on the free plan and unlimited members on the Premium plan. By joining a circle, you consent to having your name, profile photo, and activity visible to all other members of that circle.
Acceptable Use
You agree to use KinCheck only for lawful purposes. You must not:
- Use the App to monitor any person without their knowledge and consent
- Share your invite code with anyone outside your trusted family or care network
- Attempt to access another user's account or data without authorization
- Use the SOS feature for false emergencies or testing without immediately cancelling
- Reverse engineer, decompile, or attempt to extract the App's source code
- Use automated tools or bots to interact with the App or API
- Upload offensive, inappropriate, or illegal content as profile photos or check-in notes
Subscription & Billing
KinCheck offers a 7-day free trial followed by a paid subscription:
- Basic Plan: $4.99 USD per month — full family safety features (unlimited members, check-ins, SOS, medications, location)
- Premium Plan: $7.99 USD per month — everything in Basic plus Fall Detection
- Billing: Processed securely through Google Play Billing
- Auto-renewal: Subscriptions renew automatically each month unless cancelled
- Free trial: One free trial per Google account. Trial converts to paid if not cancelled before expiry
- Cancellation: Cancel anytime through Google Play → Subscriptions. Access continues until the end of the current billing period
- Refunds: Governed by Google Play's refund policy. Contact Google Play support for refund requests
We reserve the right to change pricing with 30 days' notice to existing subscribers.
Location Sharing Consent
Location sharing in KinCheck is strictly opt-in and consent-based:
- The senior must explicitly enable location sharing in the App
- By enabling location sharing, the senior consents to their location being visible to family circle members
- Family members who join a circle acknowledge they may receive the senior's location data
- Location sharing can be disabled at any time by the senior
You are responsible for ensuring that any senior using KinCheck has provided informed consent to location monitoring by family members.
Important Limitations & Disclaimer
KinCheck is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free operation of the App or notifications
- That SOS alerts or push notifications will be delivered instantly in all conditions
- Accuracy of GPS location data, which depends on the device and network conditions
- That the App will function on all Android devices or OS versions
We are not liable for any damages arising from missed check-ins, undelivered notifications, or reliance on KinCheck as a substitute for professional medical or emergency care.
Account Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms of Service
- Engage in fraudulent or abusive behavior
- Use the App to harm, harass, or monitor others without consent
You may delete your account at any time by contacting us at kincheckapp@gmail.com. Upon deletion, all your personal data will be permanently removed within 30 days as described in our Privacy Policy.
Intellectual Property
All content, design, code, and branding within the KinCheck App — including the name "KinCheck", the logo, and all user interface elements — are the exclusive property of KinCheck and protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes via push notification or in-app message. The updated Terms will be posted at this URL with a new effective date. Continued use of the App after changes constitutes your acceptance of the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of KinCheck shall first be attempted to be resolved amicably by contacting us directly.
